Meghan Markle could face ‘legal action’ over ‘plagiarism’ for her luxury brand

Meghan Markle’s branding troubles aren’t over yet.

The 43-year-old Duchess of Sussex is now facing potential legal action from a Spanish town over the logo of her newly rebranded lifestyle company, As Ever, which she introduced on Monday after scrapping the previous name, American Riviera Orchard.

Local officials in the Mallorca village of Porreres have reportedly accused Markle of copying elements from their traditional coat of arms—specifically, a lone palm tree with two hummingbirds flanking it, which closely resembles the emblem on her As Ever logo.

Mayor Xisca Mora described the resemblance between the coat of arms and the logo as “surreal” in an interview with local newspaper Ara Balears.

She also stated that the town hall is evaluating the possibility of pursuing legal action against the duchess.

“I don’t know if she visited some agritourism sites and saw the coat of arms, because the photo on her website is taken from Mallorca,” said Mora.

The mayor also noted that the village, home to around 5,000 residents and located about 22 miles from Palma, Mallorca’s capital, now “feels international” and hopes Markle’s business decision will put it on the map.

Meghan Markle announced her new brand in an Instagram video filmed by Prince Harry. “I’m shocked we’ve kept this a secret for so long,” she shared, revealing both her upcoming show and business.

Inspired by the American Riviera—a nickname for Santa Barbara—Markle launched a website featuring a logo with hummingbirds, a symbol holding deep meaning for Harry. The site also includes a touching photo of their daughter, Princess Lilibet.

Markle’s lifestyle brand launch faced delays due to a series of trademark issues. The brand, which features home essentials like tableware, kitchen linens, beverageware, and coffee and tea sets, encountered legal hurdles before its debut.

Back in September 2024, the US Patent and Trademark Office reportedly denied Markle’s application for American Riviera Orchard, citing that geographical locations cannot be trademarked.

At the time, The Post reported that her team viewed the setback as “routine and expected” in the trademark filing process.

Rival lifestyle brand Harry & David later filed a protest against Markle’s lifestyle brand, claiming the name was far too similar to its “Royal Riviera” product line.

In November 2024, Markle’s team asked USPTO for a three-month extension to launch the American Riviera Orchard brand.

When introducing As Ever on Monday, Markle pointed out the similarities between her new brand and The Tig, the lifestyle blog she shut down in 2017 after beginning her relationship with Harry.

“This new chapter is an extension of what has always been my love language, beautifully weaving together everything I cherish — food, gardening, entertaining, thoughtful living and finding joy in the everyday,” she said.

The former actress also shared: “I will keep sharing behind the scenes tidbits with you here as we ramp up to launch, and I can’t wait for you to get your hands on everything we’ve been creating.”
